Electronic discovery (“eDiscovery”) refers to the management of digital evidence in the context of litigation and regulatory matters, and it is an important part of the litigation lifecycle. Digital evidence is collected and processed so that it can be reviewed by lawyers as part of the fact-gathering process. Although eDiscovery has been part of the litigation landscape in Canada for almost 20 years, for many lawyers and other legal practitioners it still remains somewhat of a mystery.
